By participating in the
Introduce-a-Friend Programme, you acknowledge that you have read, understood and
agree to be bound by these terms and conditions. In particular, you agree to
allow Dal Cassian (gamesmaker) Ltd, and it's named product 'Crusade'
use of your name and e-mail address in connection with e-mails and any other
form of communication, it uses to contact your 'Friends' and to the limitation of
Dal Cassian (gamesmaker) Ltd's liability in connection with the Programme.
The Introduce-a-Friend Programme is only open to existing
customers of Dal Cassian (gamesmaker) Ltd and on the condition
that they have already purchased or are registered recipients of the board game
'Crusade' supplied directly through Dal Cassian (gamesmaker) Ltd.
You agree only refer the game Crusade and Dal Cassian
(gamesmaker) Ltd., to individuals that you know personally and who, in your
reasonable opinion, would wish to receive an e-mail or communication offering them the
opportunity to benefit from being given a discount voucher for the game and/or
the opportunity to enrol in such a programme themselves. All referrals must have
a United Kingdom postal address. You agree not to submit group e-mail addresses
and e-mail mailing lists of individuals unknown to yourself. You may not refer
yourself in connection with this Programme.
You may refer up to 50 Friends to Dal Cassian (gamesmaker) Ltd. You may only
refer each 'Friend' once.
Dal Cassian (gamesmaker) Ltd will, if it determines and at it's sole
discretion that you have complied with these terms and conditions, consider
sending an e-mail to each 'Friend' referred before 'the Programme' closing date.
Such closing date to be reviewed from time to time and ultimately determined by
'the Company' at it's sole discretion,
taking into account to honour any ongoing transactions. Where a 'Friend' is
already registered with Dal Cassian (gamesmaker) Ltd, the discount voucher will
not be sent. On the grounds that Dal Cassian (gamesmaker) Ltd., is
committed to protecting it's customers privacy, you will not be notified if it
is discovered that a proposed 'Friend' is one of their existing customers, nor
will it tell you which of your 'Friends' has or has not placed an order for 'the
game'. The discount voucher sent to your 'Friend' must be used towards the purchase
of at least one Crusade board game in order to qualify you for the £10
introduction reward cheque.
For each of your 'Friends' that are eligible and complete an order
under this Programme hence becoming a new customer Dal Cassian (gamesmaker)
Ltd, you will receive a cheque to the value of £10. A 'Friend' will only be
deemed to have become a new customer for the purposes of these terms and
conditions at the time the order is completed and delivered. Payments to you
will be authorized and posted to your given United Kingdom address within
28 days, not withstanding postal strikes or acts beyond our control. Cheques
will be made out in your name only, they are not transferable. The
culmination of your introduction payment cheques will not exceed £500,
however, taking into consideration the effectiveness of your introductions, you
may be offered the opportunity to become an Agent in your local area.
If 'The Company', determines in its sole
discretion that you have not complied with these terms and conditions, it may,
in addition to any other rights and remedies it may have against you,
immediately and without notice to you, withdraw all benefits to you and your 'Friends' under this
programme.
You grant to Dal Cassian (gamesmaker) Ltd, your consent for it to use your name
and e-mail address for the purposes of sending an e-mail to your 'Friends' in the manner
displayed on the Introduce-a-Friend sample e-mail. You agree not to use any
false e-mail addresses or names.
We reserve the right to alter the phraseology and text of any e-mails sent to
referrals within the framework of the general context of our specimen e-mail.
You represent and warrant to Dal Cassian (gamesmaker) Ltd., that
you have an existing personal or business relationship with each 'Friend' you are
introducing and that it is your genuine and reasonable opinion that each 'Friend'
would wish to receive an e-mail offering them the opportunity to benefit from
receiving a discount voucher for the board game Crusade and/or the opportunity
to enrol in the Introduce-a-Friend programme themselves. By providing us with the names and email
addresses of your 'Friends', you are affirmatively requesting and authorizing Dal
Cassian (gamesmaker) Ltd, to send them an e-mail, as outlined herein and
with reference to yourself as the introducer.
To the fullest extent permitted at law, neither Dal Cassian
(gamesmaker) Ltd, nor any of its associated companies, affiliates, directors,
employees or representatives will be liable for damages arising from or in
connection with the Introduce-a-Friend Programme. This limitation of liability
applies to ALL damages of any kind, whether direct, indirect or consequential,
be that damage actual or implied, including loss of data, loss of property or
damage to property, loss of income or profit and all claims of third parties.
Dal Cassian (gamesmaker) Ltd., respects the privacy of all our
clients and those introduced as potential clients. We agree to make every
reasonable effort to keep secure all personal information divulged to us no
matter how obtained. We will not pass onto any other organization outside Dal
Cassian (gamesmaker) Ltd., any information about any client without that clients
explicit permission. We ask you to supply only your 'Friends' e-mail address and
not their identity, on the grounds that they may wish to keep their anonymity
until such times as they may decide to place an order. We accept no
responsibility for the security of any links made to third party websites
through www.crusade.co.uk. We accept no liability for the security of
information transmitted to us prior to our receipt of it.
As required by the UK Data Protection Acts of 1984 and 1998 we
enforce security measures safeguarding the storage and prevention of unauthorized
access to confidential information given to us.
Undamaged and unopened items can be returned for full credit
within 7 days of their delivery. The return postage is the responsibility of the
sender and must be sent by recorded delivery. The product must be returned in
it's original protective packaging. If that packaging is damaged or in such a
condition as to not offer adequate protection to the contents, we may refuse to
accept it. The refund for transactions made by credit card will only be credited
to the credit card used for the original order. Refunds for transactions made by
cheque will be credited by cheque within 28 days. Your statutory rights apply.
If the goods you receive arrive with damaged packaging you
should refuse to accept delivery and contact Dal Cassian (gamesmaker) Ltd.
Acceptance of the delivery is confirmation that the package was received in good
condition. If upon opening the package you find the product to be damaged or
incomplete please contact Dal Cassian (gamesmaker) Ltd. within 7 days.
Your statutory rights apply.
Orders to destinations outside the United Kingdom may be subject to
import duty or custom charges prevailing in that country. It is the
responsibility of the recipient to pay these or any excess charges if imposed.
For import duty calculations in the instance of a single game being ordered, we
state the contents of the package as 'Board Game' and the value as £20 sterling.
The terms and conditions listed above may be amended or modified
by and at the sole discretion of Dal Cassian (gamesmaker) Ltd, with immediate
effect, at any time and without prior notification. Any amendments will be
posted on the terms and conditions page at the website www.crusade.co.uk and
it is your responsibility to review this page from time to time for such
amendments. If any of the provisions of these terms and conditions are held to
be invalid, that invalidity will not affect the other provisions.
The aforementioned terms and conditions will be subject to interpretation and
enforcement in accordance with the laws of the England, and you irrevocably
submit to the jurisdiction and rulings of the English courts.
